养老保险如果人死了,这钱能取出来吗？ |

法律分析：
在退休之前死了可以把养老保险里面的钱取出来，但是只能取出个人缴纳的那一部分，需要提供死亡证明及其它相关资料，比如户口本，死者直系亲属的身份证等。如果是在退休之后死了，养老保险会因此失效，不能取出来，不过其遗属可以领取丧葬补助金和抚恤金。

《中华人民共和国社会保险法》
第十一条 基本养老保险实行社会统筹与个人账户相结合。基本养老保险基金由用人单位和个人缴费以及政府补贴等组成。
第十二条 用人单位应当按照国家规定的本单位职工工资总额的比例缴纳基本养老保险费，记入基本养老保险统筹基金。职工应当按照国家规定的本人工资的比例缴纳基本养老保险费，记入个人账户。无雇工的个体工商户、未在用人单位参加基本养老保险的非全日制从业人员以及其他灵活就业人员参加基本养老保险的，应当按照国家规定缴纳基本养老保险费，分别记入基本养老保险统筹基金和个人账户。
第十三条 国有企业、事业单位职工参加基本养老保险前，视同缴费年限期间应当缴纳的基本养老保险费由政府承担。基本养老保险基金出现支付不足时，政府给予补贴。
