释义	丧葬费和死亡抚恤金不属于规定的遗产范围，不能作为遗产继承。实际支付的丧葬费超过单位给付的数额时，超过部分不能从死亡抚恤金中扣除。剩余的丧葬费、死亡抚恤金可参照遗产继承，但须照顾依靠死者生活而无经济来源的未成年人或丧失劳动能力的直系亲属。法律依据：《中华人民共和国民法典》第一千一百二十二条遗产是自然人死亡时遗留的个人合法财产。依照法律规定或者根据其性质不得继承的遗产，不得继承。
