释义	法律分析：“小三”未与有妇之夫或者有夫之妇以夫妻名义同居，不属于重婚罪。小三对对方有配偶不知情，以夫妻名义共同生活或结婚的，不属于重婚罪，但明知对方有配偶，而故意与之结婚的，或者以夫妻名义同居生活的，构成重婚罪。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。八条，有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
