强拆当事人不在场会违法吗

法律主观：
当事人不在场的情况下，若各项法律程序合法，则强制拆除也合法。根据《行政强制法》的相关规定，对于违法建筑物需要强制拆除的，应当首先发出公告，责令当事人限期拆除。当事人既不拆除也不提起诉讼或复议的，行政机关可以强行拆除。
法律客观：
《中华人民共和国行政强制法》第四十四条 对违法的建筑物、构筑物、设施等需要强制拆除的，应当由行政机关予以公告，限期当事人自行拆除。当事人在法定期限内不申请行政复议或者提起行政诉讼，又不拆除的，行政机关可以依法强制拆除。
