释义	土地通常是以抵押作为担保的方式，对土地进行抵押是权利的抵押而不是土地本身，土地权利人在法律许可的范围内不移转土地占有而将土地作为债权担保，在债务人不履行债务时，债权人有权对土地依法进行处分，并以处分所得的价款优先受偿。法律依据：《中华人民共和国民法典》第三百八十九条担保物权的担保范围包括主债权及其利息、违约金、损害赔偿金、保管担保财产和实现担保物权的费用。当事人另有约定的，按照其约定。
