释义	律师分析：强奸是用暴力以及胁迫等强硬的手段，并且还违背了女性的意愿，强行与女性发生性关系的行为。被强奸者首要是女性，且强奸者是男性。而性侵犯是指只要是违背他人意愿，与其进行有关于性方面的活动，是否是异性之间不限，是否已经发生性关系也不限。只要是进行与性相关的活动都被称为性侵。【法律依据】：《中华人民共和国刑法》第二百三十六条以暴力、胁迫或者其他手段强奸妇女的，处三年以上十年以下有期徒刑。奸淫不满十四周岁的幼女的，以强奸论，从重处罚。
