释义	法律分析：担保人未成年是否生效，要分情况: 1、十六周岁以上不满十八周岁的公民，以自己的劳动收入为主要生活来源的(视为完全民事行为能力人)，其担保有效; 2、未满十六周岁，或者十六周岁以上不满十八周岁的公民，不是以自己的劳动收入为主要生活来源的(限制民事行为能力人)，其担保无效。法律依据：《中华人民共和国刑法》第十七条十八周岁以上的自然人为成年人。不满十八周岁的自然人为未成年人。第十八条成年人为完全民事行为能力人，可以独立实施民事法律行为。
