取得烟草专卖许可证的公民，法人或者其他组织停止经营业务一年以上不办理停业手续的，经发证机关公告三个月仍未办理手续的，由发证机关收回烟草专卖许可证。
【法律依据】:
《烟草专卖许可证管理办法》 第五十二条 取得烟草专卖许可证的公民、法人或者其他组织在领取烟草专卖许可证后满6个月尚未开展生产经营活动的，视同歇业。烟草专卖行政主管部门应当收回其烟草专卖许可证。
