释义	法律分析：不算。教唆不满14周岁的人犯罪，或者教唆已满14周岁不满16周岁的人犯法律规定以外的犯罪，根据我国刑法的规定，由于这些被教唆的人不负刑事责任，因此，在这些情况下，教唆犯和被教唆的人之间不发生共犯关系，教唆犯应对其利用无刑事责任能力的人所实施的犯罪承担全部刑事责任。法律依据：《中华人民共和国刑法》第二十九条教唆他人犯罪的，应当按照他在共同犯罪中所起的作用处罚。教唆不满十八周岁的人犯罪的，应当从重处罚。如果被教唆的人没有犯被教唆的罪，对于教唆犯，可以从轻或者减轻处罚。
