释义	法律分析：民事案件的申诉期限是裁判文书生效后6个月之内。刑事上诉的期限是十天。法律依据：《中华人民共和国民事诉讼法》第二百零五条当事人申请再审，应当在判决、裁定发生法律效力后六个月内提出;有本法第二百条第一项、第三项、第十二项、第十三项规定情形的，自知道或者应当知道之日起六个月内提出。《中华人民共和国刑事诉讼法》第二百三十条不服判决的上诉和抗诉的期限为十日，不服裁定的上诉和抗诉的期限为五日，从接到判决书、裁定书的第二日起算。
