释义	带薪年休假，是指劳动者连续工作一年以上，就可以享受一定时间的带薪年假。休息权是中国宪法规定的公民权利，劳动者应当平等享有。为了平等保护各类职工的休息休假权利，充分调动广大职工的工作积极性，条例对各类用人单位实行广覆盖，规定：机关、团体、企业、事业单位、民办非企业单位、有雇工的个体工商户等单位的职工连续工作1年以上的，享受带薪年休假。单位应当保证职工享受年休假。法律依据：《中华人民共和国劳动法》第四十五条国家实行带薪年休假制带薪休假制度。劳动者连续工作1年以上的，享受带薪年休假。
