网签了还没备案的房子能退。一方可以与另一方协商一致进行解除买卖合同，进行退房，或者在合同中约定或法定的解除条件发生后向另一方送达退房通知，通知到达对方时解除买卖合同。《中华人民共和国民法典》第五百六十二条
当事人协商一致，可以解除合同。
当事人可以约定一方解除合同的事由。解除合同的事由发生时，解除权人可以解除合同。
