释义	依据规定，结婚证一般不收回。如果是法院进行的离婚，有法院的离婚判决书或者调解书就行了，结婚证不收回的。从法律意义上，自己手中保留没上缴，或者没有没收的证书是没有用的。所以，也就没有收回。《婚姻登记条例》第十七条规定，结婚证、离婚证遗失或者损毁的，当事人可以持户口簿、身份证向原办理婚姻登记的机关或者一方当事人常住户口所在地的婚姻登记机关申请补领。婚姻登记机关对当事人的婚姻登记档案进行查证，确认属实的，应当为当事人补发结婚证、离婚证。
