释义	第三者如果明知当事人的配偶尚存在合法的婚姻关系，仍与其以夫妻名义公开同居，则构成事实重婚，如果当事人为中国人民解放军现役军人配偶，且第三者明知该事实，则第三者涉嫌破坏军婚罪，应依法追究刑事责任。或者是有配偶者与他人结婚，或者明知他人有配偶仍然与其结婚或同居，处2年以下有期徒刑或者拘役。有以上情况的话，就可以告第三者，如果没有以上情况的话，就不能告第三者，告了第三者法院也不会受理，因为第三者只是违反了社会道德，并没有违反法律。
