释义	自卫情形是法定情形，必须是在法律规定的情况下才能算自卫。打架斗殴在符合下列情形时是自卫：1、自卫所针对的，必须是不法侵害；2、必须是在不法侵害正在进行的时候；3、不能超越一定限度。自卫不能超过必要的限度，如果自卫过度的程度超过刑法的某些条件，就可能负刑事责任甚至附带民事责任。法律依据：根据《刑法》第二十条规定，为使国家、公共利益、本人或者他人的人身、财产和其他权利免受正在进行中的不法侵害，而采取的制止不法侵害的行为，对不法侵害人造成损害的，属于正当防卫，不负刑事责任。
