《中华人民共和国刑事诉讼法》第62条规定，凡是知道案件情况的人，都有作证的义务。
证人在诉讼中依法负担的义务主要有：
（1）接到司法机关的通知后，应按时到场作证。确有困难不能出庭，经人民法院许可，可以提交书面证言。
（2）据实陈述和正确回答询问，如有作伪证或隐匿证据，要负法律责任。
（3）对司法机关询问的情况和本人陈述的内容保守秘密。
（4）遵守法庭纪律。
