法律分析：
侵犯商标权行为的认定：(一)必须有违法行为存在，即指行为人实施了销售假冒注册商标商品的行为;(二)必须有损害事实发生，即指行为人实施的销售假冒商标商品的行为造成了商标权人的损害后果。销售假冒他人注册商标的商品会给权利人造成严重的财产损失，同时也会给享有注册商标权的单位等带来商誉损害。无论是财产损失还是商誉损害都属损害事实。(三)违法行为人主观上具有过错，即指行为人对所销售的商品属假冒注册商标的商品的事实系已经知道或者应当知道。(四)违法行为与损害后果之间必须有因果关系，即指不法行为人的销售行为与造成商标权人的损害结果存在前因后果的关系。

《中华人民共和国商标法》 第五十七条 (一)未经商标注册人的许可，在同一种商品上使用与其注册商标相同的商标的;(二)未经商标注册人的许可，在同一种商品上使用与其注册商标近似的商标，或者在类似商品上使用与其注册商标相同或者近似的商标，容易导致混淆的;(三)销售侵犯注册商标专用权的商品的;(四)伪造、擅自制造他人注册商标标识或者销售伪造、擅自制造的注册商标标识的; (五)未经商标注册人同意，更换其注册商标并将该更换商标的商品又投入市场的;(六)故意为侵犯他人商标专用权行为提供便利条件，帮助他人实施侵犯商标专用权行为的;(七)给他人的注册商标专用权造成其他损害的。
