释义	根据《国土资源部关于印发关于加强农村宅基地管理的意见的通知》(国土资发[2004]234号)要求：“严禁城镇居民在农村购置宅基地，严禁为城镇居民在农村购买和违法建造的住宅发放土地使用证”，所以城镇居民不能在农村购置宅基地和农民住宅。法律依据《民法典》第三百六十三条，宅基地使用权的取得、行使和转让，适用土地管理的法律和国家有关规定。
