释义	法律分析：专利权自公告之日起生效。专利授权书证书上都会写明申请日和授权公告日，经专利局依法审查后，授予专利权，颁发证书并在专利登记簿上予以登记。国务院专利行政部门收到专利申请文件之日为申请日，如果申请文件是邮寄的，以寄出的邮戳日为申请日，申请人可以在被授予专利权之前随时撤回其专利申请。法律依据：《中华人民共和国专利法》第三十九条发明专利申请经实质审查没有发现驳回理由的，由国务院专利行政部门作出授予发明专利权的决定，发给发明专利证书，同时予以登记和公告。发明专利权自公告之日起生效。
