遗产一般捐给国家的民政部门，依据我国相关法律的规定，被继承人有权处理自己的财产，如果没有立遗嘱，也没有法定继承人的，遗产一般是归国家所有的。根据《中华人民共和国民法典》的相关规定：
第一千一百六十条无人继承又无人受遗赠的遗产，归国家所有；死者生前是集体所有制组织成员的，归所在集体所有制组织所有。
第一千一百五十九条继承遗产应当清偿被继承人依法应当缴纳的税款和债务，缴纳税款和清偿债务以他的遗产实际价值为限。超过遗产实际价值部分，继承人自愿偿还的不在此限。继承人放弃继承的，对被继承人依法应当缴纳的税款和债务可以不负偿还责任。
一、证明法定继承或遗嘱民法典律关系成立的证据
1、证明法定民法典律关系成立的证据
(1)被继承人死亡证明书。
(2)证明是被继承人养子女的，应提交收养关系证明书。
(3)证明是继承人以外的依靠被继承人抚养的缺乏劳动能力又没有生活来源的人的，或证明是继承人以外的对被继承人抚养较多的人的，应提交居委会、村委会或被继承人单位出具的相关证明。
2、遗嘱继承的，除应提交被继承人死亡证明书外，应提出如下证据：
(1)公证遗嘱的，应提交公证机关的公证书。
(2)代书遗嘱的，应提交代书遗嘱书并提供两个以上无利害关系的在场见证人。
(3)自书遗嘱的，应提交由遗嘱人亲笔书写、签名并注明年月日的自书遗嘱书。
(4)以录音形式立遗嘱的，除应提交有关录音外，应提供两个以上无利害关系的在场见证人。
(5)口头遗嘱的，应提供两个以上无利害关系的在场见证人。
