舅舅打外甥违法吗？ |

法律分析：
这可能是亲属间的伤害行为，也可能是不构成犯罪的违法行为或一般教育行为
如果有意伤害外甥的身体健康例如殴打而致轻伤以上，可能涉嫌故意伤害罪，根据刑法第234条的规定，处三年以下有期徒刑、拘役或者管制，致人重伤，处三到十年有期徒刑，以特别残忍手段致人严重残疾或者致人死亡，处十年以上有期徒刑、无期徒刑或者死刑。
如果是寄养在舅舅家，或舅舅同住，舅舅作为监护人长期殴打、折磨外甥，还可能属于家庭暴力，涉嫌虐待罪。犯虐待罪的，处二年以下有期徒刑、拘役或者管制；致使被害人重伤、死亡的，处二年以上七年以下有期徒刑。
但出于外甥有不良行为，对其以轻微肢体惩罚教育，符合公众通常接受范围，也没有造成严重后果，一般不认为犯罪。
对于造成轻伤害的故意伤害，如果事出有因，家庭亲属间互相谅解，也可以宽严相济，不追究刑事责任或作不起诉处理。

《中华人民共和国刑法》 第二百三十四条 故意伤害他人身体的，处三年以下有期徒刑、拘役或者管制。
《中华人民共和国未成年人保护法》 第六十条 违反本法规定，侵害未成年人的合法权益，其他法律、法规已规定行政处罚的，从其规定成人身财产损失或者其他损害的，依法承担民事责任成犯罪的，依法追究刑事责任。
