拍卖房有租赁合同，租赁合同会继续生效。在拍卖房屋之前，应提前五日通知承租人，承租人有优先购买权。
【法律依据】:
《中华人民共和国民法典》
第七百二十五条 租赁物在承租人按照租赁合同占有期限内发生所有权变动的，不影响租赁合同的效力。
第七百二十七条 出租人委托拍卖人拍卖租赁房屋的，应当在拍卖五日前通知承租人。承租人未参加拍卖的，视为放弃优先购买权。
