一、劳务合同和雇佣合同的区别
1、雇佣，是指当事人约定，一方于一定或不定期限内为他方服劳务，他方给付报酬的契约。按照梁慧星教授主持的民法典专家建议稿中的定义，“雇佣合同是受雇人向雇佣人提供劳务，雇佣人支付报酬的合同。”劳务合同虽然在实务中经常提及，但在法律条文和司法解释中没有规定。一般认为劳务是指以活动形式提供给社会的服务，通常表现为一种活劳动形态劳务关系。
2、法律依据：《中华人民共和国民法典》第四百六十四条
合同的定义和身份关系协议的法律适用，合同是民事主体之间设立、变更、终止民事法律关系的协议。依法成立的合同效力，依法成立的合同，受法律保护。
二、雇佣和劳动合同之间的关系是什么
1、一种观点认为，由于劳动合同是在十七世纪资本主义商品经济较为发达时从雇佣合同的基础上发展起来的，广义上的雇佣合同包括劳动合同。该观点为包容说；
2、一种观点取广义的劳务合同含义，劳务合同包括承揽合同、基本建设承包合同、运输合同、技术服务合同、委托合同、信托合同、居间合同、消费服务合同以及雇佣合同等以提供劳务为标的的合同。但是由于劳动关系由法律规范，所以劳务合同不包括劳动合同；
3、一种观点取狭义的劳务合同含义，把雇佣合同等同于劳务合同，把雇佣和劳务合同等同，归为一类案由“劳务（雇佣）合同纠纷”，把劳动合同和劳务（雇佣）合同并列。该观点为并列说。
