释义	法律分析：建设单位作为“招标人”办理招标应具备下列条件：（1）是法人，依法成立的其它组织；（2）有与招标工程相适应的经济、技术管理人员；（3）有组织编制招标文件的能力；（4）有审查投标单位资质的能力；（5）有组织开标、评标、定标的能力。法律依据：《中华人民共和国招标投标法》第十二条招标人有权自行选择招标代理机构，委托其办理招标事宜。任何单位和个人不得以任何方式为招标人指定招标代理机构。招标人具有编制招标文件和组织评标能力的，可以自行办理招标事宜。
