一、使用来自网络的图片怎么判断是否侵权：
1、直接使用搜索引擎抓取的图片而没有著名来源或者作者。
2、转发作者明确说明禁止转载的图片。
3、未经原作者同意对图片进行二次加工或者使用。
4、在作者未同意的情况下对图片进行商用。
5、在图片分享网站有明确的分享规定的情况下违反这些规定进行分享。
二、怎样才能维护专利侵权
专利侵权可以采取以下三种方式进行维权，包括：
1、协商，双方可以自行协商或在第三方的调解下达成和解，可向侵权方发送警告函，告知事项，并使对方重视该专利侵权的重要性；
2、行政救济，专利权人掌握充分侵权证据后，可向专利局行政部门举报，行政部门核查后，可对侵权人采取行政处罚；
3、司法救济，专利权人可以向侵权发生地、被告所在地的人民法院提出诉讼，要求对方停止侵权和进行赔偿等。
知识产权，指“权利人对其所创作的智力劳动成果所享有的专有权利”，一般只在有限时间期内有效。各种智力创造比如发明、文学和艺术作品，以及在商业中使用的标志、名称、图像以及外观设计，都可被认为是某一个人或组织所拥有的知识产权。

第一千一百六十五条 行为人因过错侵害他人民事权益造成损害的，应当承担侵权责任。依照法律规定推定行为人有过错，其不能证明自己没有过错的，应当承担侵权责任。
第一千一百六十六条 行为人造成他人民事权益损害，不论行为人有无过错，法律规定应当承担侵权责任的，依照其规定。
