释义	法律分析：三方协议可以不交违约金吗如果没有就业单位提供专项培训、约定服务期，从业人员无须承担违约责任。劳动合同法上规定的违约金只有两方面，即违反服务期约定的违约金和违反竞业限制义务违约金，除此以外，不允许设定违约金，即便设定，也因违法而无效。法律依据：《普通高等学校毕业生就业工作暂行规定》第二十四条经供需见面和双向选择后，毕业生、用人单位和高等学校应当签订毕业生就业协议书，作为制定就业计划和派遣的依据。未经学校同意，毕业生擅自签定的协议无效。
