父亲的房子该怎么继承 |

法律分析：房产继承分为法定继承和遗嘱继承两种方式。如果被继承人生前留有遗嘱的，则要按遗嘱确认该房产的继承人；如果没有，则按法定继承确定继承人，法定的第一顺序继承人为：父母、配偶、子女；第二顺序继承人为：兄弟姐妹、祖父母、外祖父母。确认好该房产的各继承人后，要先到派出所开具被继承人的死亡证明，并到被继承人生前所在单位或者村、居委会开具法定继承人证明，再准备好继承人的身份证件。准备好上述材料后，该房产的所有继承人应当一同到房产所在地的房管交易所申请过户办理，并先后进行房屋评估、继承公证、房屋测绘和继承登记，最后领取新的房产证。

第一千一百二十七条 遗产按照下列顺序继承：
（一）第一顺序：配偶、子女、父母；
（二）第二顺序：兄弟姐妹、祖父母、外祖父母。
继承开始后，由第一顺序继承人继承，第二顺序继承人不继承；没有第一顺序继承人继承的，由第二顺序继承人继承。
本编所称子女，包括婚生子女、非婚生子女、养子女和有扶养关系的继子女。
本编所称父母，包括生父母、养父母和有扶养关系的继父母。
本编所称兄弟姐妹，包括同父母的兄弟姐妹、同父异母或者同母异父的兄弟姐妹、养兄弟姐妹、有扶养关系的继兄弟姐妹。
