释义	未成年人所作的与其年龄、智力状况不相当的证言不得单独作为认定案件事实的依据。所以未成年人所作的与其年龄、智力状况相当的证言可以作为认定案件事实的依据。未成年人有义务做证人。法律依据《民事诉讼法》第七十二条，凡是知道案件情况的单位和个人，都有义务出庭作证。有关单位的负责人应当支持证人作证。不能正确表达意思的人，不能作证。
