南通最低工资标准 |

2021年最低工资标准上调至每月2320元为保障劳动者基本生活，从8月1日起，南通市调整月最低工资标准。其中，月最低工资标准从2200元调整到2320元，增加120元。非全日制从业人员小时最低工资标准为25.3元/小时，非全日制从业人员法定节假日小时最低工资标准为59元/小时。
最低工资标准，通常应当包含以下三个部分：
1、维持劳动者本人最低生活的费用，即对劳动者从事一般劳动时消耗体力和脑力给予补偿的生活资料的费用。
2、劳动者平均赡养人口的最低生活费。
3、劳动者为满足一般社会劳动要求而不断提高劳动标准和专业知识水平所支出的必要费用。
法律依据：《中华人民共和国劳动法》 第四十八条 国家实行最低工资保障制度。最低工资的具体标准由省、自治区、直辖市人民政府规定，报国务院备案。用人单位支付劳动者的工资不得低于当地最低工资标准。
《中华人民共和国劳动合同法》
第三十条 用人单位应当按照劳动合同约定和国家规定，向劳动者及时足额支付劳动报酬。用人单位拖欠或者未足额支付劳动报酬的，劳动者可以依法向当地人民法院申请支付令，人民法院应当依法发出支付令。
第四十四条 有下列情形之一的，用人单位应当按照下列标准支付高于劳动者正常工作时间工资的工资报酬：（一）安排劳动者延长工作时间的，支付不低于工资的百分之一百五十的工资报酬；（二）休息日安排劳动者工作又不能安排补休的，支付不低于工资的百分之二百的工资报酬；（三）法定休假日安排劳动者工作的，支付不低于工资的百分之三百的工资报酬。
