释义	法律分析：(1)有妇之夫或者有夫之妇与他人非法同居，被他人捉奸在床。俗称通奸”法律上没有对通奸的处罚。 (2)如果夫妻中一方因为另一方与他人同居或者重婚，向提起离婚诉讼，同时要求另一方给一方经济赔偿。 (3)一方可以按刑法自诉案，另一方构成重婚罪，前提是对方和你妻子是以夫妻的名义共同生活，而且明知你妻子有配偶。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
