释义	法律分析：一般是行政处罚的听证阶段使用，处罚机关会有一个处罚意见，用拟处罚的字样，还没有处罚效力，听证结束后，根据听证情况，“拟处罚”就会变成“决定处罚”，这时候，处罚具有执行力。法律依据：《中华人民共和国行政处罚法》第三条公民、法人或者其他组织违反行政管理秩序的行为，应当给予行政处罚的，依照本法由法律、法规或者规章规定，并由行政机关依照本法规定的程序实施。没有法定依据或者不遵守法定程序的，行政处罚无效。
