释义	法律分析：夫妻一方不同意发生性关系算强奸，无论是婚内还是婚外，只要是以暴力、胁迫或者其他手段，违背妇女意志，强行与之性交的行为都构成强奸罪。虽然我国刑法原则上将在法定婚姻关系存续期间丈夫违背妻子的意愿、强行发生性关系的行为排除在强奸之外；但是如果造成伤害后果或者有虐待等其他严重情节的，可以以其他罪如故意伤害罪、虐待罪等论处。法律依据：《刑法》第二百三十六条以暴力、胁迫或者其他手段强奸妇女的，处三年以上十年以下有期徒刑。奸淫不满十四周岁的幼女的，以强奸论，从重处罚。
