(1)文书名称，即“刑事附带民事起诉状”；
(2)附带民事诉讼原告人、附带民事诉讼被告人的姓名、性别、出生年月日、民族、出生地、文化程度、职业或者工作单位和职务、住址。
2、正文应当写明：
(1)诉讼请求；
(2)事实与理由；
(3)证明损失的证据等。
诉讼请求，应当写明请求附带民事诉讼被告人赔偿的项目和具体数额。事实，应当写明因附带民事诉讼被告人的犯罪行为给被害人、附带民事诉讼原告人造成实际经济损失的情况。理由，应当根据有关法律规定，写明为什么应当电附带民事诉讼被告人承担民事责任。证明损失的证据，应当一一列明名称、种类及来源。
3、尾部应当写明：
(1)致送人民法院的名称；
(2)附带民事起诉状的份数；
(3)附带民事诉讼原告人签名或者盖章；
(4)具状时间。
