释义	合议庭是人民法院审判案件的基本审判组织，其成员不是固定不变的，而是临时组成的，由院长或者庭长指定审判员一人担任审判长。院长或庭长参加审判案件的时候则自己担任审判长。合议庭评议案件时，如果意见分歧，应当少数服从多数，但是少数人的意见应当记入评议笔录，由合议庭的组成人员签名。法律依据《中华人民共和国民事诉讼法》第四十一条
