释义	1、《中华人民共和国农村土地承包法》第三十八条规定：“土地承包经营权采取互换、转让方式流转，当事人要求登记的，应当向县级以上地方人民政府申请登记。未经登记，不得对抗善意第三人。”2、物权采用登记设立原则。土地承包经营权虽然也是用益物权，而《物权法》明确规定土地承包经营权自土地承包经营权合同生效时设立。所以说该经营权无需登记生效。只要双方签订了相应的承包合同，自承包合同生效之日起，该承包经营权就生效了。
