释义	法律分析：羁押前流产的还能用死刑。犯罪的时候不满18周岁和审判的时候怀孕的妇女，不适用死刑。根据相关司法解释，所谓“审判的时候怀孕的妇女”，是指人民法院审判的时候，被告人是怀孕的妇女，也包括审判前被羁押时已是怀孕的妇女。但是，如果行为人在怀孕期间实施了犯罪行为，一时并未被人发觉，待胎儿出生或者流产之后，才受到羁押审判的，不应当属于“审判的时候怀孕的妇女”。法律依据：《中华人民共和国刑法》第四十九条犯罪的时候不满十八周岁的人和审判的时候怀孕的妇女，不适用死刑。
