释义	法律分析：先诉抗辩权，指一般保证的保证人在主债权人向其请求履行保证责任时，有权要求主债权人先就债务人财产诉请强制执行；在主合同债权债务纠纷未经审判或仲裁，并就主债务人财产依法强制执行仍不能履行债务前，保证人可以对主债权人拒绝承担保证责任的特殊抗辩权。法律依据：《中华人民共和国民法典》第六百八十七条第二款一般保证的保证人在主合同纠纷未经审判或者仲裁，并就债务人财产依法强制执行依然不能履行债务前，对债权人可以拒绝承担保证责任
