释义	可以向债务人的遗产继承人主张权利，在继承遗产范围内偿还债务，协商不成，债权人向法院起诉，继承人放弃继承的，用债务人遗产偿还债务。法律依据：《最高人民法院关于贯彻执行若干问题的意见》第六十二条规定：“遗产已被分割而未清偿债务时，如有法定继承又有遗嘱继承和遗赠的，首先由法定继承人用其所得遗产清偿债务;不足清偿时，剩余的债务由遗嘱继承人和受遗赠人按比例用所得遗产偿还;如果只有遗嘱继承和遗赠的，由遗嘱继承人和受遗赠人按比例用所得遗产偿还。”
