释义	目前国内没有任何法律条文明确禁止18周岁以下的未成年人饮酒，即未成年人喝酒是不违反法律的，但是若饮酒后做了违背法律的事情会根据年龄大小量刑，确定是否承担刑事责任。我国《刑法》第17条规定：“已满16周岁的人犯罪，应当负刑事责任。已满14周岁不满16周岁的人，犯故意杀人，故意伤害致人重伤或死亡、强奸、抢劫、贩卖毒品、放火、爆炸、投毒罪的，应当负刑事责任，已满14周岁不满18周岁的未成年人犯罪，应当从轻或减轻处罚。
