释义	法律分析：（一）含有超标准的有毒有害物质的；（二）不含所标明的有效成份，可能贻误诊治的；（三）标明的适应症或者功能主治超出规定范围，可能造成贻误诊治的；（四）缺乏所标明的急救必需的有效成份的。法律依据：《中华人民共和国刑法》第一百四十二条生产、销售劣药，对人体健康造成严重危害的，处三年以上十年以下有期徒刑，并处罚金;后果特别严重的，处十年以上有期徒刑或者无期徒刑，并处罚金或者没收财产。药品使用单位的人员明知是劣药而提供给他人使用的，依照前款的规定处罚。
