释义	法律分析：涉嫌犯罪是指国家司法机关根据某起案件的具体情况对某个人员有所怀疑而且有证明表面该案件可能是他作为不是所说的故意犯罪这个是不同概念只有人民法院经依法审理后，判决是否有罪，其他任何人、任何机关都没有权力确定某一行为是否构成犯罪，某一人是否有罪。因此，公安机关、检察机关在办理案件的过程中，在表述“犯罪”的时候，前面要加上“涉嫌”两字。法律依据：《中华人民共和国刑事诉讼法》第十二条未经人民法院依法判决，对任何人都不得确定有罪。
