法律分析:
嫖娼属于违法行为，但不是犯罪行为。一般情况下，嫖娼会被处五天以上十五天以下的行政拘留，并处五千元的罚款。如果是已满十四周岁未满十六周岁的嫖娼者，不会执行行政拘留。如果是已满十六周岁未满十八周岁且初次触犯治安管理处罚法的嫖娼者，不会被执行行政拘留，但是会被执行行政罚款。如果是七十周岁以上的嫖娼者，不会被行政拘留。如果嫖娼者不在以上的年龄段内，那么应该既被拘留，又要被罚款。
法律依据:
《中华人民共和国治安管理处罚法》 第六十六条 卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款节较轻的，处五日以下拘留或者五百元以下罚款。在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。一、卖淫、嫖娼行为，有下列情形之一的，属于违反《治安管理处罚法》第六十六条第一款“情节较轻”的情形，处五日以下拘留或五百元以下罚款：1、已谈妥价格或者给付金钱等财物，尚未发生性关系的、初次卖淫、嫖娼行为，认错态度好，表示悔改且具有其他特殊原因的、其他情节较轻情形的。二、因卖淫、嫖娼被依法予以罚款、行政拘留、收容教育、劳动教养执行期满后三年内又卖淫、嫖娼的，报劳动教养。三、引诱、容留、介绍他人卖淫的，有下列情形之一的，属于违反《治安管理处罚法》第六十七条规定“情节较轻”的情形，处五日以下拘留或五百元以下罚款：1、引诱、容留、介绍卖淫，卖淫行为未遂的、不以营利为目的、其他情节较轻的。四、因引诱、容留、介绍他人卖淫，被依法判处刑罚执行完毕后五年内，或者被劳动教养执行完毕后三年内，或三年内受过二次以上行政处罚、一年内受过一次行政处罚后，又引诱、容留、介绍他人卖淫的，报劳动教养。五、卖淫嫖娼案情复杂，按上述卖淫嫖娼处罚标准进行裁量仍有过重或过轻之嫌的，提交局领导召集有关人员集体讨论决定。
