释义	法律分析：员工先写好辞职报告，再提前一个月提交给单位的负责人，就可以解除合同。在试用期内，劳动者要提前三天通知用人单位，这样也可以解除劳动合同。即使用人单位不同意劳动者辞职，劳动者也可以在用人单位收到辞职报告的三十天后，进行工作交接再离职。这时双方就已解除劳动关系。劳动者可以要求用人单位结算在职期间的工资。法律依据：《中华人民共和国劳动合同法》第三十七条规定，劳动者提前三十日以书面形式通知用人单位，可以解除劳动合同。劳动者要在试用期内提前三日通知用人单位，也可以解除劳动合同。
