释义	法律分析：上位法优于下位法即下位法与上位法冲突时,以上位法为据,不再适用下位法。效力层级：(1)宪法>法律>行政法规>地方性法规>本级和下级地方政府规章; (2)省、自治区的人民政府制定的规章>本行政区域内设区的市、自治州的人民政府制定的规章。法律依据：《中华人民共和国立法法》第八十七条：宪法具有最高的法律效力，一切法律、行政法规、地方性法规、自治条例和单行条例、规章都不得同宪法相抵触。
