释义	法律分析：是不违法的,和有配偶者开房是通奸行为，我国法律并不规制通奸行为，因而不犯法，但是不道德。但是如果明知他人有配偶而与之结婚的，将构成重婚罪；明知是现役军人的配偶而与之同居或者结婚的，将构成破坏军婚罪。相关法律规定有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
