符合以下要件即可判断构成传播性病罪：
在客观方面表现为严重性病患者实施卖淫嫖娼的行为；
犯罪客体为他人的身体健康和社会治安管理秩序；
行为人是已满十六周岁、具有刑事责任能力，且患有梅毒、淋病等严重性病的人；
在主观方面表现为故意，过失不构成本罪。
行为人犯此罪的，处五年以下有期徒刑、拘役或者管制，并处罚金。

不构成犯罪。传播性病罪，是指明知自己患有梅毒、淋病等严重性病而进行卖淫、嫖娼的行为。本罪在客观方面表现为严重性病患者实施卖淫嫖娼的行为。卖淫、嫖娼是相对应的行为，卖淫是指以营利为动机，与不特定的异性发生性交或从事其他淫乱活动，嫖娼则是指以交付金钱或其他财物为代价与卖淫者发生性交或从事其他淫乱活动。
二、容留他人吸毒罪的犯罪构成要件
容留他人吸毒罪的犯罪构成要件：1.本罪侵犯的客体是社会的正常管理秩序和人们的身心健康；2.本罪在客观方面表现为行为人实施了容留他人吸毒的行为；3.本罪的主体为一般主体，即凡是达到刑事责任年龄具有刑事责任能力的人，均可构成本罪；4.本罪在主观方面表现为故意，过失不构成本罪。《中华人民共和国刑法》第三百五十四条规定，容留他人吸食、注射毒品的，处三年以下有期徒刑、拘役或者管制，并处罚金。
