15岁不能做兼职，要求用人单位不得招录未满16周岁的未成年人，换言之，能够做兼职的最小年龄其实就应该是16周岁。若单位有招录童工的行为，必然就要对用人单位作出相应的处罚。法律依据：《中华人民共和国劳动法》 第十五条 禁止用人单位招用未满十六周岁的未成年人。文艺、体育和特种工艺单位招用未满十六周岁的未成年人，必须依照国家有关规定，履行审批手续，并保障其接受义务教育的权利。
