释义	法律分析：借据上有注明最好，证人证言或者公安的询问笔录等也可以，只要是能让法官采信认定是赌债就不受法律保护。不存在实际的借贷行为，或借贷关系双方虽有借贷行为发生，但借款用于支付赌债，用途不合法，违反法律和社会公共利益，当属无效民事行为，均应认定为赌债，赌债自始不产生债的效力，法律不予保护。法律依据：《关于人民法院审理借贷案件的若干意见》第十一条出借人明知借款人是为了进行非法活动而借款的，其借贷关系不予保护。
