释义	法律分析：三方协议的作用有很多，对学校、用人单位以及大家本人，都是一种保障，但是大学生们在就业实习阶段时，三方协议可不要乱签，不然可能会有麻烦。毕业生签订就业协议时仍然是学生身份，但是签订劳动合同时应当是劳动者身份。劳动合同一经签订，就业协议的效力应当丧失。若劳动合同与三方协议附件内容矛盾，则以劳动合同为准。法律依据：《中华人民共和国劳动合同法》第七条用人单位自用工之日起即与劳动者建立劳动关系。用人单位应当建立职工名册备查。
