释义	法律分析: 我国的《刑法》中没有通奸罪这一说法，但当事人一方或者双方为已婚，自愿发生性关系的行为可能构成其他犯罪。如果一方为现役军人的配偶，将构成破坏军婚罪。如果一方不满十四周岁的幼女，将构成强奸罪。如果双方通奸行为满足事实婚姻认定标准，将构成重婚罪。法律依据: 《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
